South Carolina Clinical Laboratory Requirements

South Carolina requires state personnel licensure for anyone performing nonwaived clinical laboratory testing: the MLS, categorical MLS, and MLT license categories sit under the Board of Clinical Laboratory Science (S.C. Code Ann. Title 40, Chapter 48), and using the MLS, MT, or MLT title without a license is prohibited. The owner accepted this personnel-licensure finding on 2026-10-19. On the facility side, the reported finding is that no separate state facility license applies and CLIA covers the laboratory — confirm your facility's status with the state.

Scope of this guide

This guide addresses a typical independent commercial clinical laboratory testing human specimens; it is not a legal opinion or final facility-opening checklist. Facility licensure, personnel licensure, hospital/facility rules, out-of-state testing permits, payer enrollment, and specialty rules are separate questions — confirm each with the state authority. "Needs state confirmation" means no definitive conclusion was established; it does not mean the state has no additional requirements. Before relying on this guide, verify with the state: ownership/facility type, testing complexity and specialties, whether specimens are collected or tested in-state, whether tests are sent out of state, and whether personnel licenses are required.

State agency

The Board of Clinical Laboratory Science, South Carolina Department of Labor, Licensing and Regulation (LLR), is the personnel-licensing authority under S.C. Code Ann. Title 40, Chapter 48 (§§ 40-48-120 through 40-48-180) — §40-48-120 states the licensure requirement, §40-48-130 creates the Board, and §§210-240 cover temporary licensure, reciprocity, applications, and 3-year validity.

License types

The statute provides the following personnel-license categories:

  • Medical laboratory scientist (MLS) — requires a baccalaureate degree from an accredited institution, qualifying clinical laboratory experience or training, passage of a national certification examination (ASCP Board of Certification or American Medical Technologists), and the continuing-education requirements of the certifying organization (§ 40-48-180).
  • Categorical medical laboratory scientist / medical technologist — licensure in a specialty category.
  • Medical laboratory technician (MLT) — the associate-level license category.
  • Title protection and practice restriction (§ 40-48-170): a person who is not licensed is barred from performing nonwaived clinical laboratory tests and from holding themselves out as an MLS, MT, categorical MLS/MT, or MLT, or using those designations. Employers are barred from knowingly employing or designating an unlicensed person as a medical laboratory practitioner unless the person is exempt.

How to apply

Apply to the Board of Clinical Laboratory Science for licensure in your category. The application package covers education, national certification examination results, and continuing-competency documentation; submit supporting documents directly to the Board as its instructions specify.

Personnel requirements

The statute requires mandatory state licensure for everyone performing nonwaived testing (MLS, categorical MLS, MLT), per §§ 40-48-170 and 40-48-180. MLS candidates need a baccalaureate degree, qualifying clinical experience or training, a passing national certification examination, and ongoing continuing education through their certifying organization. Title misuse — using MLS, MT, or MLT without the license — is a statutory violation.

Inspection

The Board has regulatory authority over licensed practitioners, including discipline. Facilities receive federal CLIA surveys; surveyors will expect the personnel on the roster to hold current South Carolina licenses.

Renewal and changes

Renew licenses on the Board's schedule and maintain the continuing-education requirements of your certifying organization. Keep the Board informed of changes so the license record stays current.

How South Carolina differs from federal CLIA

  • Individual personnel licensure is mandatory for nonwaived testing — a state license beyond CLIA's qualification standards and beyond national certification alone.
  • Statutory title protection: MLS, MT, and MLT designations may not be used without the license.
  • On the facility side, the reported finding is that CLIA covers the facility and no separate state facility license applies; confirm your facility's status with the state.
